1.- Previous information
These Terms and Conditions regulate the access and contracting by Professional Users of the Services that the Platform www.zentrosakro.com (here and after “Platform”) owned by MASAJISTIKOS, S.L (hereinafter, “ZENTRO SAKRO”) , with CIF B44858256, and registered office at Calle Santa Faz, 47, bajo comercial, 03501 Benidorm, Alicante, Spain.

For the purposes of these Terms and Conditions, a Professional User shall be understood as any individual who, within the scope of their commercial, business, trade or profession, accesses the Platform with the aim of announcing the offer of their Services. (hereinafter, the "Professional User").

2.- Acceptance of the Terms and Conditions
By accepting the T&C, the Professional User undertakes to act at all times in accordance with the provisions established in the clauses of this legal text, which define the rights and obligations of ZENTRO SAKRO and the Professional User regarding the relationship contractual that derives from the use of the services accessible through the Platform.

These are the only Terms and Conditions applicable to the use of the Platform by the Professional User (without prejudice to the fact that for certain services there will be particular conditions) and replace any other conditions.

Zentro Sakro will proceed to register the Professional User after reviewing their application and the documentation provided to certify that they have the qualifying qualification to offer the Professional Services of the Platform.

The individual agreements with the Professional User, (including the annexes, addendums and modifications) will in any case have priority over the T&C. The signature or written confirmation of ZENTRO SAKRO will be sufficient to confirm the content of such agreements, unless there is sufficient evidence to prove otherwise.

Access, registration, browsing, use, hosting and/or downloading of content and/or use of the web services of any Platform by minors (under 18 years) is prohibited. By accepting these Terms and Conditions, the Professional User declares to be over 18 years of age and have the legal capacity to contract and acquire the services present on the Platform.

3.- Object
This Platform has been developed by ZENTRO SAKRO in order to create a space that allows the Professional User to offer their professional services related to massages (here and after, the "Services").

4.- Operation of the Platform
In order for Professional Users to be able to enjoy the services implemented on the platform, ZENTRO SAKRO must take into account the following:

4.1. Professional User Registration
In order to proceed with the publication of the Services for their offer and making them available to Consumer Users, the Platform offers the Professional User the possibility of creating an account through an online form that must be completed with the data required therein.
Those companies, organizations or professionals interested in registering as a Professional User to advertise and offer their massage services (hereinafter, “Professional Services”) on a recurring basis must fill out the form designated for this purpose, which can be found here or send an email. email to info@zentrosakro.com with the subject HIGH PROFESSIONAL.

Zentro Sakro will proceed to review the application, professional experience and adequacy of the degree required to offer professional massage services on the Platform. If documentation or additional information is required in this regard, Zentro Sakro will proceed to request it.

Once their suitability for the provision of the Services offered on the Platform has been confirmed, ZENTRO SAKRO will facilitate the use of personal passwords to the Professional User who registers as such on the Platform. These passwords will be used to access the services provided through the Platform.

Professional Users will be fully responsible for the use of their Professional User account. Consequently, Professional Users are responsible for the proper custody and confidentiality of the Professional User name and/or passwords that allow access to their account, and undertake not to assign their use to third parties, whether temporary or permanent, or to allow access to third parties.
 

By virtue of the foregoing, Professional Users must immediately notify ZENTRO SAKRO through the email info@zentrosakro.com of any improper use of their Professional User name and/or password, due to circumstances such as theft , loss or unauthorized access to them, so that ZENTRO SAKRO can proceed to their cancellation or blocking and/or disabling as soon as they are aware of the improper use of their Professional User Account. As long as such facts are not reported, ZENTRO SAKRO will be exempt from any liability that may arise from the improper use of Professional User names or passwords by unauthorized third parties.

Professional Users assume full responsibility for their use of the Platform. The Platform can provide Professional Users with access to a large amount of text, graphics, drawings, designs, photographs, multimedia content and information (hereinafter, the "Content") belonging to ZENTRO SAKRO or third parties.

The Professional User undertakes, in general, to use the Platform diligently, in accordance with the law, morality, public order and the provisions of these Terms and Conditions, and must also refrain from using them in any way that may prevent, damage or deteriorate the normal operation and enjoyment of the Platform by Professional Users or that could injure or cause damage to the assets and rights of ZENTRO SAKRO, its suppliers, Professional Users or in general of any third party. Without limitation, Professional Users agree not to use such Content or Services to:
 

1. Make unauthorized or fraudulent use of the Platform;

2. Access or attempted access to restricted resources of the Platform;

3. Use the Platform for illicit, illegal and/or contrary to the provisions of these Terms and Conditions, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload or prevent the normal use or enjoyment of the platform;

4. Cause damage to the Platform or third party systems;

5. Introduce or spread computer viruses or any other physical or logical systems that may cause damage to the systems of ZENTRO SAKRO or third parties;

6. Attempting to access, use and/or manipulate the data of ZENTRO SAKRO, of other Users or of third parties;

7. Reproduce, copy, distribute, transform or modify the contents, allowing access to third parties through any form of public communication, unless you have the authorization of the holder of the corresponding rights or it is legally permitted;

8. Obtain or try to obtain the contents by means or procedures other than those that, where appropriate, have been made available for this purpose;

9. Attempting to access and/or use the email accounts of other Users and/or modify or manipulate their messages; and

10. Users will not transmit their Professional User name and password to unauthorized third parties and will immediately inform ZENTRO SAKRO of the access of an unauthorized Professional User.
     

In addition, Professional Users agree to keep the information in their account accurate, complete and updated (name, surname, telephone number, email, etc.).

The Professional User understands and accepts that they will be responsible for the advertised Services, and that these must be in accordance with the law and public order. It is prohibited to advertise or offer the following Services through ZENTRO SAKRO:

• Erotic massages

• Naked massage or naked masseuses

• massage exchange service

• Sexual massages, happy ending or with a happy ending

• Escort or hostess services

• Any type of massage or Service similar to those indicated.
   

In relation to the foregoing, ZENTRO SAKRO reserves the right to deny any attempt to access the Platform, block a User account, delete or modify content, or cancel the provision of Services in cases where there is an incorrect use of the Platform, also being able to exercise all legal actions that may correspond, with the Professional User being responsible for the expenses that such acts may cause, as well as for the damages caused.
 

5.- Prices and payment methods for the Services
Once the Professional User is correctly registered, they will be able to access the ZENTRO SAKRO Services and publish the Professional Services they wish to offer to the Consumer User.

5.1. Prices

The publication of the offer of Professional Services is free.

The prices of services that appear on the ZENTRO SAKRO Platform are expressed in euros, and include VAT, and vary depending on the Services and the minutes offered by the professional. In any case, minimum rates are recommended.

ZENTRO SAKRO reserves the right to modify the prices displayed on the web, notifying it as soon as possible, and respecting the previous prices for those Users who have already purchased its services.
Payments by Users will be made in EUROS, without deductions and free of charges through the bank account or another method designated by ZENTRO SAKRO. The payment of the corresponding fee for the services will be paid to the Professional User on the 1st and 15th of each month to the account established by the Professional User.

5.2. Cancellation services
Once the registration registration request has been processed, it will not be possible to cancel or modify it until next month, notifying ZENTRO SAKRO through the following email: info@zentrosakro.com

Notwithstanding the foregoing, the Professional User may request the cancellation of the registration as a professional on the platform at any time. The order will be processed 30 days after the request.

The Professional may cancel the reservation of the Services by the Client User up to 24 hours before, as long as they notify him and offer him a solution.

Unjustified cancellation less than 24 hours in advance will result in a penalty. With three penalties, the Professional Account will be deleted and, unfortunately, you will not be able to offer your Services on the Platform again.

If the cancellation of the Service is communicated more than 24 hours in advance, there will be no penalty and another professional will be authorized for the Client whose appointment has been cancelled.

5.3. Fees for services
ZENTRO SAKRO charges 25%+VAT from any job the therapist perform. This means that they will earn 70% of the value of the service.

6.- Obligations of the Professional User
ZENTRO SAKRO is not an organizer, professional, or responsible for the massage services and activities offered through its Platform. ZENTRO SAKRO only provides a platform to publish the Services, which allow the Professional User to prepare a catalog of services and promotions of their massage activities to the Consumer User, but all sales are the responsibility and competence of the Professional User.

This being the case, ZENTRO SAKRO acts as an intermediary between consumers and Professional Users solely for the purpose of advertising the services of Professionals and using the payment systems of third-party providers in order to collect payments issued by Consumer Users of the Services with regarding the professional massage services offered and process those payments.

The obligations of the Professional User are:

6.1. Ensure that the advertisement posted to offer your services complies with all applicable local, state, provincial, national and other laws, rules and regulations, and that the services described on any page posted about the event are satisfactorily represented.
6.2. Offer services for which the Professional User is duly trained and for which he holds a valid certificate that accredits him as a professional in the matter.
6.3. Hire or have civil liability insurance that protects you against Consumer claims for the services offered on the Platform or for injuries that occur in the performance of your professional activity;
6.4. Take responsibility and hold ZENTRO SAKRO harmless with respect to any loss, sanction, penalty and/or third-party claim for damages imposed on ZENTRO SAKRO and that is the consequence of an action, omission, negligence or use contrary to the provisions of this contract. or in the legislation by the Responsible.
6.5. Verify that the individuals who participate in your activities are registered to participate in said events and/or activities.

 

7.- Intellectual and Industrial Property
All rights to the content, design and source code of this Platform and, in particular, including but not limited to, all rights to the photographs, images, texts, logos, designs, trademarks, trade names, data that is included in the Platform and any other intellectual and industrial property rights are owned by ZENTRO SAKRO, or by third parties that have expressly authorized ZENTRO SAKRO to use them on its Platform.

For this reason and by virtue of the provisions of Royal Legislative Decree 1/1996, of April 12, which approves the consolidated text of the Intellectual Property Law, regularizing, clarifying and harmonizing the legal provisions in force on the matter (in hereinafter, "Intellectual Property Law"), as well as in Law 17/2001, of December 7, on Trademarks and the complementary legislation on intellectual and industrial property, the reproduction, transmission, adaptation, translation, distribution is expressly prohibited. , public communication, including the way it is made available, of all or part of the contents of the Platform, in any support and by any technical means, unless expressly authorized in writing by ZENTRO SAKRO.

Specifically, and by virtue of the provisions of national, European and international regulations on intellectual property, the use of all or part of the contents of this website and specifically the content produced by ZENTRO SAKRO, for commercial purposes, is expressly prohibited. , in any support and by any technical means, without the authorization of ZENTRO SAKRO.

The Professional User agrees to respect the Intellectual and Industrial Property rights owned by ZENTRO SAKRO. The Professional User must refrain from deleting, altering, evading or manipulating any protection device or security system that was installed on the ZENTRO SAKRO Platform.

ZENTRO SAKRO does not grant any license or authorization of use of any kind on its intellectual and industrial property rights or on any other property or right related to the Platform, and in no case will it be understood that the access and navigation of the Professional User implies a resignation, transmission, license or total or partial assignment of said rights by ZENTRO SAKRO.

Any use of these contents not previously authorized by ZENTRO SAKRO will be considered a serious breach of intellectual or industrial property rights and will give rise to the legally established responsibilities.

8.- Protection of personal data
ZENTRO SAKRO guarantees the security and confidentiality of the personal data that Users provide in compliance with the provisions of Regulation 2016/679 of April 27, 2016 regarding the protection of natural persons with regard to the processing of personal data. and the free circulation of these data (hereinafter, "RGPD") and Organic Law 3/2018, of December 5, Protection of Personal Data and guarantee of digital rights (hereinafter, "LOPDGDD")

In this sense, Users are informed that, in terms of privacy and protection of their personal data, they can exercise the following rights:

3. Request the deletion of your data;

4. Request that the processing of your data be limited;

5. Oppose the processing of your data;

6. Exercise your right to be forgotten; and

9.- Modifications
The information that appears on this Platform is current on the date of its last update. ZENTRO SAKRO reserves the right to update, modify or delete the information on this Platform, as well as these Terms and Conditions, the privacy policy or any other information.

The entry into force of the modifications of the terms and conditions will take place from the moment of their publication on this Platform.

10.- Safeguard clause
All the clauses or extremes of these conditions of use must be interpreted independently and autonomously, the rest of the stipulations not being affected in the event that one of them has been declared null by judicial sentence or final arbitration resolution. The affected clause or clauses will be replaced by another or others that preserve the effects pursued by the conditions of use.

11.- Jurisdiction and jurisdiction
These General Conditions of sale are subject to compliance and interpretation to the applicable Spanish legislation.

Any eventual conflict that arises in relation to the provisions of these T&C will be resolved by the courts and tribunals of Benidorm, the Professional User expressly renouncing his own jurisdiction of being another.
